1. Services

MassLabs 3D provides design, prototyping, manufacturing, consulting, and related services. All services are subject to availability, project requirements, and our acceptance of your order or request.

We reserve the right to refuse service for any project that violates applicable laws, regulations, intellectual property rights, or our company policies.

2. Quotations and Orders

All quotations are provided based on the information available at the time of request.

Quotes may be subject to revision if:

• Project specifications change
• Submitted files contain errors or omissions
• Additional work is required
• Material, labor, or shipping costs change

An order is considered accepted only after written confirmation from MassLabs 3D.

3. Customer Responsibilities

You are responsible for ensuring that:

• All files, drawings, and specifications submitted are accurate.
• You have the legal right to use and reproduce any submitted designs.
• Submitted content does not infringe upon any third-party intellectual property rights.
• Products and services ordered comply with applicable laws and regulations.

MassLabs 3D is not responsible for errors resulting from inaccurate or incomplete customer-provided information.

4. Intellectual Property

Customers retain ownership of any original files, designs, drawings, trademarks, or other intellectual property submitted to MassLabs 3D.

By submitting files or project information, you grant MassLabs 3D a limited license to use those materials solely for the purpose of reviewing, quoting, manufacturing, and completing your requested services.

Unless otherwise agreed in writing, MassLabs 3D retains ownership of its proprietary processes, workflows, website content, branding, and associated intellectual property.

5. Confidentiality

MassLabs 3D will make reasonable efforts to maintain the confidentiality of customer project information and design files.

However, unless covered by a separate Non-Disclosure Agreement (NDA), submitted information should not be considered legally protected confidential information.

Customers requiring additional confidentiality protections should request an NDA before sharing sensitive information.

6. Payments

Payment terms will be specified in quotes, invoices, or project agreements.

MassLabs 3D reserves the right to:

• Require deposits before work begins
• Suspend work for overdue accounts
• Withhold shipment or delivery until payment is received
• Charge applicable taxes and fees

All payments are due according to the terms stated on the invoice unless otherwise agreed in writing.

7. Shipping and Delivery

Delivery dates are estimates and are not guaranteed.

MassLabs 3D is not liable for delays caused by:

• Shipping carriers
• Supply chain disruptions
• Material shortages
• Force majeure events
• Customer-requested changes

Risk of loss transfers to the customer upon shipment unless otherwise agreed in writing.

8. Returns and Refunds

Due to the custom nature of our services, custom-manufactured products are generally non-refundable.

Refunds, replacements, or corrections may be considered if:

• The delivered item materially differs from approved specifications
• The product is defective due to manufacturing error

Customers must notify MassLabs 3D of any issues within 7 days of delivery.

9. Limitation of Liability

To the fullest extent permitted by law, MassLabs 3D shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Lost profits
• Lost business opportunities
• Loss of data
• Project delays
• Business interruption

Our total liability shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.

10. Product Use

Customers are solely responsible for determining whether any product, prototype, component, or design is suitable for its intended use.

MassLabs 3D does not certify products for safety-critical, medical, aerospace, automotive, structural, or regulatory applications unless explicitly stated in writing.

Customers assume all risks associated with the use of products provided by MassLabs 3D.

11. Website Use

You agree not to:

• Use the website for unlawful purposes
• Attempt to gain unauthorized access to systems or data
• Interfere with website functionality
• Upload malicious software or harmful content
• Violate applicable laws or regulations

We reserve the right to restrict or terminate access to users who violate these terms.

12. Disclaimer of Warranties

All services, products, and website content are provided "as is" and "as available" to the fullest extent permitted by law.

MassLabs 3D makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Indemnification

You agree to indemnify and hold harmless MassLabs 3D, its owners, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:

• Your use of our services
• Your submitted content
• Violations of these Terms of Service
• Violations of intellectual property rights or applicable laws

MassLabs 3D may update these Terms of Service at any time. Updated terms will be posted on this page with a revised effective date.

Continued use of the website or services after changes become effective constitutes acceptance of the updated terms.
